3. Acceptance of Terms and Conditions

It is a condition of accessing and using the Services that you acknowledge and agree to comply with these Terms and our Privacy Policy (your agreement).

• Divine Soul Psychics may change its Website and/or the Terms, including terminating the Services, so you should check the Terms from time to time for any changes. If you do not agree to these Terms you must immediately terminate your membership by sending an email here. If you choose to continue to be a member of our Website, you agree to any new Terms.
• Divine Soul Psychic is committed to a world without violence, including verbal and physical. We believe that everyone has a right to live without abuse. Clients/Members who engage in any abusive or threatening language or activity to any of our contractors may have their access restricted to our service at any time, without notice.
• Please go to our Psychic Reading Prices for more information. When our psychics read, a psychic should be in an altered state of consciousness which, by its very nature is outside time. Consequently, the responsibility for time keeping rests with the customer and not the psychic. This ensures you receive the best possible flowing and focussed reading for you by the psychic.
• At our discretion, clients may have their speaking time with our psychics limited (Block Time) without notice.

4. Privacy Policy

Any information collected and used by Divine Soul Psychics is used as set out in our Privacy Policy and you hereby agree to accept those terms as if they were a part of these.

5. Intellectual Property

Copyright in the website pictures and in the Divine Soul Psychics website is property of Divine Soul Psychics. Material on this website also comprises copyright material, trademarks and registered trademarks which are the property of Divine Soul Psychics and third parties. This property may only be used for the purposes of browsing the Divine Soul Psychic website and acquiring goods and services of Divine Soul Psychics.

6. Purchasing Goods and Services

• Your Role
  If you purchase goods and services from Divine Soul Psychics or create a membership account with us, we may require you to provide your name, telephone number, address, email address or other details (“customer information”). We may subsequently require further details to enable the processing of any orders that you make. You agree to provide Divine Soul Psychics with current, complete and accurate customer information when asked to do so by the website or a contractor of Divine Soul Psychics. All care is taken to ensure that the Divine Soul Psychics website and data transmissions are free from viruses. However, it is your responsibility to scan any data or websites for viruses. The purchase of goods and services is restricted to individuals of 18 years of age or older. Individuals under the age of 18 may have purchases made on their behalf by a parent or guardian or with express consent.
• Security
  Using our online ordering system provides you with a safe method of ordering. Our credit card processing system uses the latest SSL secure connection technology, which encrypts the information so it is protected from unauthorised use. Your payment details will be verified and authorised when you place your order. In the case of products and services, your payment will be debited from your account before we send the goods or supply services.
• Product Information
  Prices of goods and services, postage and handling fees, and other charges displayed on the Divine Soul Psychics website are current at the time of display. These prices are subject to change without notice. While there are not likely to be discrepancies with product descriptions and pricing, we are unable to warrant that product descriptions or other content of the website is provided accurately, current or error free upon its addition to the website.
• Placing and Accepting Orders
  Orders will not be dispatched until payment in full has been received and Divine Soul Psychics is satisfied with the integrity of the order. Please note Divine Soul Psychics is not responsible for any loss or damage caused by late delivery or cancellation of an order or a product. Placement of an order by you constitutes an offer from yourself to enter into an agreement with us. We will email you an Order Confirmation for the sole purpose of confirming the details of your order. Please note that our Order Confirmation does not constitute an acceptance of your order or reflect the status of your order in any way. For SMS purchases see Clause 9 below.
• Payment
  All prices shown on the home page are in the currency of the country selected by you or automatically detected. All transactions through our online shopping facility and over the phone are in Australian Dollars (AUD$). Phone Calls are billed to your credit card at a rate of $2.99 per minute from a landline and $2.99 per minute from a mobile phone to Australian residents. Credit Card Calls with our Customer Service Booking Managers have a minimum billing time of 15 minutes. Where payment for a psychic reading is declined due to insufficient funds, Divine Soul Psychics reserves the right to attempt to secure the outstanding funds, from another credit card, on that client’s member record.
• Cancellation by Us
  We reserve the right not to provide goods or services, terminate membership accounts, remove or edit content or cancel orders (or part thereof) at our sole discretion at any time. Without limiting the operation of any other Terms of Sale herein, we will not be held liable for loss or damage arising from the exercising of these rights.
• Cancellation by You
  If you need to cancel an order, please contact us immediately on XXXX or email. Our agreement with you only comes into existence once we have both confirmed your order and your payment has been processed. Once we have accepted payment for an order, cancellation of the order is within our sole discretion. Orders that cannot be canceled will be subject to our terms, conditions and policies relating to Returns and Exchange.
• Delivery
  1) Enter the correct email address details at the time of ordering. Should you enter the wrong address, please advise us immediately. We will provide you with an estimated date for delivery of all services. While we make every effort to deliver by this time, all dates specified are estimates only.
  2) For SMS purchases see Clause 9 below. We have aligned ourselves with delivery companies who we believe will do their best to deliver products by the estimated delivery date.
  3) It is the responsibility of the customer to inform Divine Soul Psychics if an order does not arrive. Once we learn an order has not arrived by the due date, we will lodge enquiries with the delivery company to ensure delivery occurs as soon as possible. We will not be held liable for any loss or damage resulting from late delivery. Please note that if an item has been lost in transit, we will not dispatch a replacement item immediately.
  4) Replacement items will be dispatched solely at our discretion.
  5) Without limiting the effect of any of our other Terms and Conditions herein, we will not accept liability for any loss or damage arising from a late delivery, you agree that a late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation of an order.
• Without limiting the effect of any of our other Terms and Conditions herein, we will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.
• Psychic SMS Text
  i) Divine Soul Psychics undertakes responsible action to ensure delivery of SMS text messages. There are, however, some circumstances where SMS text messages may be delayed or not delivered, which are outside the control of Divine Soul Psychics. Reasons for delivery delay or failure include but are not limited to difficulties with technology, equipment failure, the receiving device may be switched off or not working properly, the destination number is invalid or the device may have full storage. Furthermore, the destination number may be invalid or barred to SMS. The client may be overseas and relying on an overseas carrier to deliver the message but it may fail to do so. Local telecommunications carriers may also experience complicated technical difficulties delaying or failing to deliver text messages. Often several telecommunications companies may be involved in delivery of SMS text messages and it is impossible to ascertain at what part of the delivery mechanism, the delivery fails or is delayed. Divine Soul Psychics therefore gives no warranty as to timeframe SMS text messages may take to be delivered.
  ii) Our Psychic SMS Text Service is not intended to replace phone psychic readings. SMS text is intended for quick, short answers of a general nature only. Particularly sensitive or important matters are not suitable for SMS and we recommend a phone reading in these cases. Due to the nature of transmission and the fact that SMS texts are a very truncated form of communication, we do not give any warranty as to the accuracy or suitability of SMS text to provide suitable guidance for your situation. If you have any doubts about the suitability of SMS text for your situation, please use our phone psychic reading service which will provide caring, non-judgmental spiritual guidance more suited to your needs.
• Purchase Receipt
  Your purchase receipt appears as the charge on your credit card statement from Universal Readings.

7. Right of Refusal of Service

Divine Soul Psychics and its contractors reserve the right to refuse service to any customer at their sole discretion, subject to Victoria Australia law.

8. Limitation of Liability

Any liability of Divine Soul Psychics or its authorised representatives in connection with goods or services supplied by us to you will, subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, at the election of Divine Soul Psychics limited to:

• In relation to goods, the replacement or repair of the goods, the supply of equivalent goods, the payment of the cost of replacing or repairing the goods or the payment of the cost of obtaining equivalent goods; and
• In relation to services, the supplying of the services again or the payment of the cost of having the services supplied again
• These Terms and Conditions are governed by the laws in force in Victoria, Australia and you irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Victoria, Australia and any courts, which may hear appeals from those courts.

9. Disclaimer

• Divine Soul Psychics has a psychic network of independent contractors. We do our best to ensure all our psychics are professional psychics. However, we make no warranty about their skill.
• While we endeavour in every way to provide accurate informative material on this site, in reports and during readings, we cannot and will not be held responsible for your use of such information and material. Your life is your responsibility and you are the architect of your own life. All readings, reports and information are given as guidance only. You must make your own decisions and consult the relevant professionals for professional matters such as medical, legal, financial, psychological and otherwise.
• Divine Soul Psychics will not be liable for any damages, loss or injury that accompany or result from your use of this site.
• Divine Soul Psychics is not liable for your inability to process any transactions due to transmission problems and assumes no liability for any data loss, delay in receiving or damage during the transmission of services e.g. your mobile drops out while on a premium rate call. You agree that Divine Soul Psychics has no responsibility or liability for the transmission of content by this service, other than above.
• To the fullest extent permitted by applicable law, Divine Soul Psychics disclaims all representations and warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Divine Soul Psychics makes no warranty that this website, any information or ideas contained on this website or any products or services will meet your requirements.
• You expressly acknowledge and agree that Divine Soul Psychics does not control other users of this website, the providers of information or ideas to this website or the suppliers of goods and services purchased from this website, and Divine Soul Psychics is therefore not liable for their opinions or their behaviour, including any information or advice provided by them or any defamatory statements made by them or any offensive conduct on their part.

You will indemnify Divine Soul Psychics and all contractors and contractors associated with Divine Soul Psychics against any legal action including claims, demands, damages, responsibility, costs or expenses including legal fees that may be incurred due to using our Website, Service or any information published on that Website or someone else using your membership, or if you cannot, for whatever reason, use our Website.

11. Laws that Apply

These terms are governed by the laws of Victoria, Australia and you agree to follow these rules. Even if a Victorian court agrees that some part of this Agreement is not valid, the rest of the Agreement will remain valid.

12. Complaints, Ideas or Suggestions?
